helohi.io provides AI voice agents that may record calls on behalf of your business. This page explains what you need to know as a helohi.io tenant regarding call recording consent laws in the United States.
When a caller reaches your helohi.io AI agent, the call is handled and recorded by our infrastructure (powered by Retell AI and Twilio). Recordings and transcripts are stored securely and made available to you in your dashboard. See our Privacy Policy for retention periods.
Most US states follow a one-party consent rule: only one participant in a call needs to consent to the recording. Because your AI agent is a party to the call, this requirement is typically satisfied.
However, some states require all-party (two-party) consent, meaning every participant must be informed and consent before a call is recorded. These states currently include:
Laws change. Verify the current law in any state where your callers may be located.
For tenants who indicate they are in a two-party consent state (or who serve customers in those states), helohi.io's AI agents include the following disclosure in the opening line of every call:
“This call may be recorded for quality and training purposes.”
This disclosure is designed to satisfy the notification requirement in two-party consent states. However, we cannot guarantee it satisfies every applicable law in every jurisdiction. Review your agent's greeting and consult legal counsel if needed.
If you configure a custom greeting or opening line for your agent, we recommend including a disclosure along these lines:
“Hi, this is [Business Name]'s AI assistant. This call may be recorded. How can I help you today?”
You can customize the exact wording in your agent configuration. The key element is that the caller is informed of recording before any substantive conversation begins.
Under your helohi.io Terms of Service, you are responsible for ensuring your use of the Service complies with all applicable laws, including call-recording consent laws in your jurisdiction and the jurisdictions of your callers. helohi.io is not liable for your failure to comply with these laws.
